Alguien ha tenido la paciencia de recopilar y colgar en Internet todo un catálogo de horrores de nuestra vida pública, y al consultarlo (www.corrupciovalenciana.blogspot.com) sientes cómo de la pantalla emana una bocanada de hedor. En términos forenses corrupción es la putrefacción de los cuerpos muertos, y Josep Lluís Barona también describió el miércoles, como factores de fermentación, la codicia, la opulencia, la avaricia, el imperio de la vergüenza, la economía canalla y la mafia calabresa. Daba paso el presidente de Valencians pel Canvi a un análisis a tres bandas sobre la producción de cadaverina social en base a escenas de vodevil, redes clientelares, abuso de los equipos "de confianza", generalizadas corruptelas de baja intensidad, prácticas mafiosas, degradación moral de tantos colaboracionistas que ceden a las presiones, persecución y muerte política de quienes denuncian, estructuras de partido dañadas, relaciones personales imposibles, inoculadas de rencor, inquina y odio...

El título del debate era Corrupción contra democracia y vimos que en este encuentro el marcador presenta de momento un resultado inquietante. En palabras de Ernesto Sábato: "No ignoramos que la famosa Democracia baja a la democracia con minúscula y, por fin, a la que debe ser escrita entre comillas. Precisamente, la democracia parte de la idea de que el hombre es el lobo del hombre, y para colmo, un lobo corrompible".

Somos humanos, necesitamos leyes que nos protejan de esta condición. También se dijo. Pero fallan los mecanismos jurídicos, los órganos de control social, los medios de comunicación de masas como contrapoder, ejerciendo un marcaje disuasorio. Acordamos esa noche con Ángel Luna, Mònica Oltra y Francesc Arabí que Gürtel no es causa sino consecuencia, y que más que lo que nos roban lo grave es que parece que nos da igual. Y estos ejemplos de descomposición que ahora flotan en el ciberespacio (y que guardados en papel ocupan tantos metros cúbicos) nos proporcionan la deprimente y desmovilizadora sensación de que nuestros municipios (con la excusa de que necesitan dinero) albergan con gusto vertederos de residuos morales; de que la pudrición es generalizada, y de que se nutre de la impunidad política y judicial. Un ejemplo sotto voce: Nules, caso Fabra. Juez que recibe amenazas. Juez que pide traslado. Juez que no denuncia presiones. Conclusión: juez que no cree en la Justicia ni en la Democracia. Y así casi todo. Luego nos quejamos de la desafección por la política y de la tolerancia y la comprensión con que buena parte del voto respalda este bastardeo de los ideales.

Urge volver a Sábato: "Esos famosos tres poderes y esa libertad de información son los instrumentos mejor concebidos para lograr que la más perversa de las criaturas vivientes haga el menor de los daños posible. En suma: la democracia es precaria y a menudo despreciable, pero hasta hoy no hemos encontrado nada mejor para alcanzar las futuras comunidades a que aspiramos".

Una vivienda centenaria de pescadores en Lanzarote, a punto de ser derribada mientras decenas de hoteles de lujo ilegales siguen en pie

La casa donde vivía desde hace tres generaciones la familia de Santiago Medina Cáceres, carpintero jubilado de 73 años de edad, tiene los días contados. Se trata de una morada de pescadores de más de 100 años de antigüedad situada en la costa de Berrugo (Yaiza), al sur de Lanzarote, en una zona entre Papagayo y Playa Blanca. Esa casa es un bastión para los ciudadanos que llevan años defendiendo otro modelo turístico para Lanzarote. Será historia en cuestión de días, mientras decenas de hoteles ilegales siguen funcionando.La casa ha sido ya desalojada por un auto dictado por la jueza María Dolores García Benítez, del Juzgado número 2 de Arrecife, que obliga a la ejecución provisional de una sentencia que exige la entrega de la casa a la Junta de Compensación de un plan urbanístico. En el auto figura la autorización expresa a la comisión judicial a que recabe el auxilio de la fuerza pública, si hubiera oposición.

En esta casa ha vivido la misma familia desde el tatarabuelo de Santiago Medina. Como otras construcciones tradicionales de la costa de Canarias, la propiedad nunca figuró en ningún registro. Según explican fuentes de la defensa de los Medina, en 1986 unos empresarios registraron el terreno fraudulentamente. Posteriormente, lo vendieron a los promotores del plan llamado Castillo del Águila, y a su alrededor la casa vio crecer apartamentos, hoteles, comercios y un puerto deportivo.

Sólo la casa, ejemplo de la arquitectura popular canaria, con 400 metros de inmueble en un solar de más de ochocientos metros, recuerda cómo fue aquel lugar. Hoy está retirada de la orilla por las diversas edificaciones. El centro comercial ni siquiera estaba contemplado en el proyecto inicial de la Marina Rubicón, ambos construidos en terreno ganado al mar. Al centro comercial se opuso la Dirección de Costas, pero nunca llegó a actuar, según afirma Pedro Hernández, portavoz del grupo ecologista El Guincho.

Ahora, la juez decide que la propiedad debe pasar a la Junta de Compensación del plan urbanístico. Y el derribo es inminente. La decisión es llamativa en una isla en la que hay sin ejecutar al menos 37 sentencias firmes desde hace tiempo que declaran ilegales las licencias de numerosos hoteles. Esas sentencias son firmes, pero los hoteles siguen en funcionamiento en esa misma costa sur de Lanzarote (según datos de la página web del propio Cabildo de Lanzarote, legalidadurbanistica.org).

La sentencia contra la familia Medina no es firme, ya que está recurrida ante la Audiencia Provincial de Las Palmas. Sin embargo, a su casa le quedan horas. Según piensan los propietarios, una vez desalojados el derribo será inminente, como ya sucedió en otros lugares de Lanzarote; "En Tías [otro municipio] no esperaron a que se viera el recurso, y luego resultó que se anuló la licencia del campo de golf".

La jueza ha declinado hacer declaraciones a EL PAÍS. Según la información recabada ante el Juzgado de Arrecife por el gabinete de prensa del Tribunal de Justicia de Canarias, el auto de ejecución provisional no se trata de un desahucio técnicamente, sino que se da posesión a su propietario según el artículo 41 de la Ley Hipotecaria.

Santiago Medina, el más pequeño de una familia de diez hermanos, de los que sólo quedan vivos seis propietarios del inmueble, dice que han decidido sacar sus enseres y no estar cuando llegue el agente judicial acompañado de la fuerza publica, "porque ya somos muy mayores y tenemos muchos achaques, y ni el corazón, ni el azúcar nos permite aguantar más este avasallar". En torno a este caso se articuló, hace aproximadamente diez años, por primera vez un movimiento popular para frenar la presión urbanística sobre la isla.

"Son muchos años de batalla", añade Medina, "pero estoy orgulloso y agradecido porque gracias a esta lucha, los vecinos de la isla se manifestaron masivamente y se consiguió que el Cabildo y la Fundación César Manrique recurrieran a la Justicia para poner freno a la terrible especulación del litoral que hay en Lanzarote".

De la casa de los Medina hasta hoy cuelga una pancarta con un lema: "Si luchamos podemos perder, si no lo hacemos estamos perdidos", una expresión que se ha hecho popular más allá de la isla.

Entre los vecinos relevantes que apoyan está causa se encuentra el Premio Nobel de Literatura, José Saramago. "Los turistas son como abejas, pero pican", suele decir Saramago. En varias conferencias públicas en la isla ha reclamado dignidad y que se cumplan las sentencias, sin buscar estratagemas para transigir con la especulación.

News that many of the people visiting international property shows in the UK last year were still looking to move abroad, specifically Spain, indicates that while the downturn has made a difference, there are signs that things are beginning to happen and that the green shoots of recovery, although sparse, are starting to make an appearance.

Spain's main competitors were the USA and Australia and New Zealand, which have been offering immigration packages at some shows. But the survey results from these shows are especially good news for Spain, which is confirmed to be the favourite destination of potential property-buyers still with over 60 per cent of visitors indicating an interest in Spain. France came a poor second despite its familiarity and geographical proximity to British buyers.

Surveys of the public attending the show indicated that many buyers have been waiting for the right moment, and are now thinking about making a move, as the thinking is that house prices are unlikely to drop any further.

The reasons for choosing Spain, were, as one would expect, the climate, the friendly people, and previous holidays in certain areas in the past. It was also noted that buyers were now more aware of the problems now facing property investors who had chosen destinations that were not offering many flights in and out.

Some places have even cancelled flights altogether while others have cut drastically during the crunch but locally, Malaga airport continues to be served by numerous airlines with dozens of flights every day to the UK.

However, what is it exactly they can expect when they get here? As more and more we about cases hear concerning expats duped into buying illegal properties or falling foul of a law that has previously been ignored. The case in  Albox, Almeria where nine British home owners stand to lose their homes following a demolition order has now developed into a diplomatic row with Ambassador Giles Paxman getting involved and asking for a meeting to try and resolve the situation.

President of the Junta de Andalucía, José Antonio Griñán, told Press last Thursday that he had not received 'any notification or letter' from the British Ambassador to Spain, Giles Paxman, regarding the demolition of the nine British owned properties but British diplomats are insisting that Ambassador Paxman has written and sent a fax, but speaking to journalists in Córdoba, José Antonio Griñán, said that the building licences for the properties had already been contested by the Junta at the time as not being considered as legal. He insisted that the Junta had therefore met its obligations regarding the matter, and that the properties were illegal.

the Junta's Councillor for Housing, Juan Espadas, has now made a call for calm from the nine property owners insisting that his department would be looking at the matter 'case by case' and that problem had arisen because of the 'speculative interests of professional defrauders' who had attracted foreign investors by offering the chance of building on non-buildable land without explaining exactly what any problems could be.

AUAN, the Association against infringing people's Property Rights, said in a statement released on Friday, 'We are protesting against legal and planning uncertainty, against bad administration and corruption, against the failure to respect citizens' human rights and against the failure of the administration to comply with European Parliament resolutions'.

Spanish national and MEP Marta Andreason told Spanish Prime Minister Zapatero in the European Parliament today that she was ashamed to see what is going on in Spain in relation to urban abuses.
She told Mr Zapatero, who was outlining the Programme of the Spanish Presidency of the EU Parliament in Strasbourg, that she represented constituents in the South East of England, some of whom are suffering from urban abuses and are unable to occupy their properties. She said that if a solution was not found during Mr Zapatero´s Presidency she will personally do all she can to make sure EU threats to block subsidies to Spain are carried through.
Ms. Andreasen made specific mention of the case of Mr and Mrs Prior two years ago in Vera and told Mr. Zapatero “We want a solution now. We want the people to be able to live in the houses they bought. If this is not possible they need to be granted a fair compensation.”
Interventions from MEPs on the problems of urban abuse in Spain have come about partly as a result of a concerted campaign by the federation of urban abuse organisations, including AUN and AUAN in Spain. Despite three reports approved by the European Parliament urging the Spanish authorities to take action, nothing has been done so far to protect those suffering the consequences.
Other MEPs Glenis Willmott (Labour) and Diana Wallis (Liberal Democrat and Vice-President of the European Parliament) also appealed for a solution to urban abuses and land grab scandals on behalf of British victims. Michael Cashman, MEP, has already written a personal appeal to the Spanish Prime Minister stating that “It is the Spanish government alone that can bring an end to these abuses”.

El europarlamentario del partido laborista británico Michael Cashman ha dirigido una carta abierta al presidente del Gobierno español, José Luis Rodríguez Zapatero, en la que le insta a adoptar medidas urgentes que eviten la demolición de casas ilegales en las comunidades de Andalucía, Valencia y Murcia, ante la evidencia de que los abusos urbanísticos se han "generalizado" en España.

Cashman justifica su decisión de escribirle «de nuevo» sobre este asunto debido a "hechos recientes que han alertado sobre la generalización de los abusos urbanísticos en España, en particular en las comunidades de Valencia, Murcia y Andalucía". Decenas de miles de personas de todos los países de la Unión Europea se han visto ahora afectados por las irregularidades cometidas, explica el eurodiputado. Y revela que más de 15.000 quejas de protesta y cartas han llegado a su oficina en relación a este asunto, y que lo siguen haciendo a diario.

Cashman asegura que se han mantenido encuentros "sobre el terreno" con muchos de los afectados y se han recogido evidencias que forman parte de informes dirigidos al Parlamento Europeo. "Ya no hay ninguna excusa para mantener la inacción a partir de ahora", afirma tajante.

El laborista hace referencia, a continuación, a las últimas órdenes de demolición dictadas por el Tribunal Superior de Justicia de Andalucía (TSJA) para jubilados británicos residentes en el municipio almeriense de Albox: "Desgraciadamente, el nuevo año ha empezado de la peor manera posible en Andalucía, donde ocho propietarios de Albox se han encontrado con la orden de demolición de sus viviendas".

En 2002, recuerda el británico, el Ayuntamiento de esta localidad concedió las correspondientes licencias municipales para estas casas. Sin embargo, en el mismo año, la Junta de Andalucía revocó esta decisión y después de un lento proceso judicial las licencias se han declarado nulas. "Las casas fueron compradas con buena fe y en conformidad con la leyes de propiedad, con la esperanza de sus propietarios de disfrutar de un retiro en paz, que ahora se trastoca con la inminente demolición".

AUAN MEETS WITH THE ANDALUCÍAN OMBUDSMAN

The AUAN would like to thank the Andalucian Defensor Del Pueblo for the warm welcome he gave them at a meeting in Seville last Friday. The Defensor (ombudsman) is the high commissioner of the Andalucían Parliament and is appointed to protect the fundamental rights and public freedoms enshrined in the Spanish Constitution. The meeting was facilitated by Izquierda Unida and, apart from those representing the AUAN, was attended by Rosalía Martín and Antonio Romero of the IU.

Also present was Mrs Helen Prior, who is an example of one of the many victims of construction and urban planning abuses which seem to be devastating Spain. You will recall that Mr and Mrs Prior´s house was demolished two years ago, despite having a building license, and they have been living in the garage beside the ruins of their bulldozed home ever since with no glimmer of any compensation.

The Ombudsman was interested in hearing about this case and Mr and Mrs Prior are going to present a formal complaint to him.

We explained to the Ombudsman that the Junta de Andalucía now appears to want to follow the lamentable case of Mr and Mrs Prior with a series of eight more demolitions in Albox, all of which properties are in possession of licenses which were subsequently revoked by the Junta.

We put it to him that the question is really very simple: is it not patently unjust to throw pensioners, who acted in good faith, out onto the street, when the proceedings against them originated as a struggle between two branches of the Spanish state?

We argued that it is a basic right in international law, and binding on the administration, that no-one should be deprived of a property which was acquired in good faith without guarantee of fast, efficient and just compensation. The AUAN pointed out some of the international obligations to this effect, among them the Universal Declaration of Human Rights approved by the UN General Assembly in 1948, the European Convention for the Protection of Human Rights and the European Union Charter of Human Rights.

The AUAN alleges that the Junta is sheltering behind their own interpretation of the law, and argued that the law does not exist in a vacuum, it is made by politicians and it cannot enshrine human rights abuses. The law cannot embody antisocial practices.

The Ombudsman indicated that he was familiar with this problem and interested in the matter. He said that, among other actions, he would speak to Sr Juan Espadas, the Minister for Housing and Territorial Planning.

Meanwhile, Michael Cashman MEP, has written an open letter to Prime Minister Zapatero. Mr Cashman was one of the MEPs who asked for a European Parliamentary resolution to get Spain to put its house in order given the enormous number of petitions and complaints about building, environmental and urban abuses it had received. According to Mr Cashman there have been over 15,000 petitions as well as a daily flood of letters on this matter.

He addressed his letter to Sr. Zapatero as co-President of the European Council. He speaks of urban abuses in general, of his daily delivery of letters of complaint, and says that the response of the government to European Parliament resolutions has been only inaction. He specifically mentioned the case of the eight properties under threat of demolition in Albox and he urges Mr Zapatero to intervene to avoid making victims out of those who have acquired their properties in good faith hoping to enjoy their retirement. Don’t forget that one of the affected owners who faces being thrown out onto the street is more than 80 years old.

On another front the scandal about Albox is spreading on an international level; the Daily Mail ran a piece last week where one of the affected couples told the newspaper that if the authorities were to demolish their home they would have to do so with them still in it.

According to information we have it looks as if this is going to get even more complicated for the Junta: the EU Petitions Committee is going to meet to have a look at the situation and various MEPs are showing a great interest in the apparent injustice of it, including Willy Meyer, the IU member of the Petitions Committee. We also know that the British Ambassador has written to Sr. Griñan, the President of the Junta of Andalucía and that the British Consul has been in contact with the victims.

AEPA, the association of small Albox businesses, has complained that in their understanding of some of the statements made by representatives of the Junta, buyers are being incited to start legal proceedings against their builders. The Albox PP and PSOE parties also now seem to be entering the fray, with each party blaming the other for the deteriorating image of the town.

AUAN would like to make it clear that we are NOT a political association, though we are grateful for the attention being paid to this problem by the Izquierda Unida. We acknowledge the courage of the Mayor of Albox in saying that the demolition of homes is a barbarity. We are planning to meet with the PP in the next few days to explain to them the situation in which our members find themselves.

AUAN advocates an intelligent and consensual solution agreed between the civil servants, interested associations and political parties. They should analyse the entire construction and urban planning chaos and shape new draft legislation.

Meanwhile there should be no recourse to the demolition of houses bought in good faith without adequate compensation.

For many years AUN and other associations have fought against uncontrolled and unsustainable urban development in the Valencian Community. During this period, we exchanged views with many of you on the status of planning in general, as we became aware that rampant urban development was not exclusive to our Community. Indeed, it has become rather wide spread and essentially covers the whole country like a mediaeval plague. Each autonomous region has adopted laws similar to the Valencian land laws that encourage speculation and outrageous planning, with its attendant corruption, rising house prices, environmental degradation, while burying us in asphalt and cement. “Urbanismo” has been seen as a rich source of instant wealth feeding the politicians’ and developers’ insatiable appetites.

All this is still happening around us, despite some considerable achievements in our campaign against urbanistic and environmental abuses. AUN brought these to the attention of the European Parliament and the European Commission, resulting in a series of devastating parliamentary reports (Fortou and Auken) against the Valencian and other regions’ town planning laws, while AUN’s complaint to the Commission was ruled admissible before the European Court in Luxembourg and is in process. A favourable decision, i.e. a decision against Spain, can affect all other regional planning laws in the points they have in common.

For these reasons and because we have seen that in many regions similar groups in Spain have organized to defend their rights to property ownership, the undersigned agreed to establish a Spanish Federation of Associations with the common interest of truly sustainable development, while defending our human rights, especially those relating to property ownership and fighting against urban and environmental abuses, in accordance with Spanish, EU and international law.

The purpose of this letter is therefore to advise you of the creation of a Spanish Federation of Associations in Defense of Human rights and against Urban and Environmental Abuses (Federación Española de Asociaciones en defensa de los Derechos Humanos y en contra de los Atropellos Urbanísticos y Medioambientales).

Después de años de lucha contra el urbanismo descontrolado e insostenible que hemos sufrido en la Comunidad Valenciana, años en los que hemos cambiado impresiones con muchos de vosotros sobre la situación del urbanismo en general, hemos apreciado que ese urbanismo rampante, no era, ni es una exclusiva de nuestra Comunidad. Por el contrario es un mal estatal, abarca a todo el territorio. En cada autonomía se han aprobado leyes urbanísticas que propician esos desmanes, con sus secuelas de corrupción, encarecimiento de la vivienda, degradación del medio ambiente y sellado del suelo por cemento y asfalto. El urbanismo ha sido interpretado como fuente de enriquecimiento, para unos políticos de moral acomodaticia con código de barras y unos especuladores de apetito insaciable, y se ha extendido por todo el territorio español como una epidemia medieval.

Todo eso a pesar de algunos logros en esa lucha, como el haberla llevado al Parlamento y a la Comisión Europea, dando lugar a unos informes demoledores contra el urbanismo valenciano el llamado informe Fourtou y al urbanismo español en el más reciente y conocido informe Auken, así como la admisión a tramite de la denuncia presentada ante el Tribunal de Justicia Europea de Luxemburgo contra la Ley Urbanística Valenciana, cuya sentencia si nos es favorable podrá afectar a todas las demás leyes urbanísticas autonómicas en los puntos que tengan en común.

Por todo esto y porque hemos constatado que en cualquier rincón de España se han organizado colectivos en defensa de sus derechos y propiedades, generalmente de carácter local, hemos procedido a fundar una Federación Española de asociaciones con el interés común de la defensa del territorio, por un urbanismo realmente sostenible.

Este es el motivo de esta comunicación, nos complace anunciaros la creación de la Federación Española de Asociaciones en defensa de los Derechos Humanos y en contra de los Atropellos Urbanísticos y Medioambientales.
